CONTEST RULES

FLAPDADDY ONLINE CONTEST OFFICIAL RULES. ONLY FOR AMATEURS.

1.  Introduction. Flapdaddy Productions, Inc. ("Flapdaddy") is offering the online contests (the "Contest") to registered users or members who enter the Contest ( the "Contestants"). VOID WHERE PROHIBITED. The $10,000.00 contest shall be open to any person who is a registered user of a free account with Flapdaddy.com. The $1,000,000.00 contest is open only to members of Flapdaddy.com who have registered and paid for a member account.

2.  Eligibility. Contestants must be sixteen (16) years or older. Contestants under the age of eighteen (18) must have parental permission before entry. Do not proceed to enter the Contest if you are: not at least sixteen years of age. Employees of Flapdaddy; its parents, subsidiaries, affiliated companies, and agents thereof, as well as production personnel for the television program, advertising agencies, corporate sponsors or any person or entity connected with the production, administration, or any of the parent companies, affiliates, subsidiaries, agents or representatives of any of the foregoing entities,and the immediate family (defined as parents, spouse, children, siblings, grandparents) of each such employees, and all those with whom such employees are domiciled, are NOT eligible. The contest is open to amateur performers and artists only. Actor entrants may not be professional actors or performers (including, but not limited to, members of the Actors' Equity Association, Screen Actors Guild and the American Federation of Television and Radio Artist), and may not be assisted by such professionals. Contestants who are asked to audition for the semi-final round of the competition must be able to demonstrate (before being allowed to participate) that they do not have any of the following:
  • a contract for talent representation (for example, a talent agent or manager);
  • a music recording contract;
  • an acting and/or modeling contract;
  • a merchandising agreement; or,
  • any other contractual arrangement that would prohibit you from entering into an exclusive management contract, recording contract, talent contract, acting contract and/or merchandising contract.
Disqualifications: Flapdaddy reserves the right to disqualify and/or exclude, in its sole and absolute discretion, any individual from any of the contests for any reason or for no reason at all, including without limitation, violation of any portion of these rules, or tampering with the entry process or the audition process. If a Contestant is disqualified, NO PART of the entry fee will be refunded. Contestants agree that being chosen to compete at any level in the process is no guarantee that the Contestant will be selected to continue to the next stage.

3.  The Contest: The Contest begins in October, 2006. All voting is based upon unique votes per video.
  • Contestants can enter as many videos as they like. Contestants will be rated based upon the total number of individual views of each video. These ratings are based on an aggregate total of all views of all videos a Contestant has entered into the Contest.
  • The first week of the contest ends on the first Wednesday of January, after the 2nd day of January. The first week's ratings will be based on the total number of individual views between the end of the previous year's contest and the end of the first week of the current contest. Ratings during subsequent weeks of the contest will be based only on the number of individual views during the one week of the contest. Individual views will be calculated from 12:00 AM Thursday to 12:00 AM Wednesday of the following week. All times are based on Central Standard Time in the United States of America.
  • At the conclusion of each weekly time period, Flapdaddy will calculate the rating for each Contestant by adding together the total number of individual views for all videos entered by each contestant and announce through emails to the winning contestants and on the website who that week's winners are. The weekly winners will then be allowed 24 hours to select and upload no more than three (3) videos for entry into the Semi-Finals. Flapdaddy will broadcast a live show no less than 24 and no more than 48 hours after the conclusion of the weekly contest, during prime-time. In addition, Flapdaddy will choose from the audience that is connected to the site and viewing the show, one (1) or more persons to submit a video for addition to the show currently being broadcast. At the end of the broadcast, each currently connected user and contestant will each get one (1) vote to cast for the broadcast contestants.
  • The Winner of the Weekly group will advance to the 8-week Weekly Semi-Final.
  • At the end of the 8th week of each 8-week period, Flapdaddy will broadcast the weekly show as scheduled, and then all the Weekly winners will have 24 hours to choose and submit 3 videos for the Semi-Finals. Flapdaddy will schedule a live broadcast no less than 24 and no more than 48 hours, after the conclusion of the 8th weekly broadcast show. CONTESTANTS WILL BE REQUIRED TO BE ONLINE AND AVAILABLE FOR A LIVE INTERVIEW IN PERSON OR VIA A WEBCAM DURING THE SEMI-FINAL AND FINAL SHOWS TO WIN.
  • The Users and Contestants online and present during the show will be allowed the chance to vote on the Winner. The winners will go on to the Finals to be broadcast after week 40.
4.  The Prizes: The prize of the $1,000,000.00 contests is estimated to be valued at $1,000,000.00, in merchandise, services, cash, or any combination thereof. The prize of the $10,000.00 contest will be paid in cash. In the event that Flapdaddy has less than 25,000 contestants enter the $1,000,000.00 contest, the prize of that contest will be reduced to 80% of the amount collected for entry fees during the contest period as allowed by law.

5.  Content Rules: Entries will be disqualified by Flapdaddy if they are reported and believed to contain material which is (or promoting activities which are) sexually explicit, obscene, pornographic, violent (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, or harassing.

All audition video clips submitted must be the original creation of the performance entrant, and the entrant must own all right, title and interest in all aspects of the entry. By submitting an entry or accepting any prize, Contestants represent and warrant that any audition video(s) submited (a) are their original creation in accordance with these Rules; (b) have not been copied in whole or in part from any other work; (c) do not violate or infringe any copyright, trademark, privacy, publicity, or other proprietary right of any person or entity, and (d) are their sole and exclusive property. NO AUDITION CLIPS OR MATERIALS SUBMITTED, REGARDLESS OF FORMAT, SHALL BE RETURNED.

5.  Other Terms and Conditions. By entering either contest, the winner agrees that Flapdaddy and those acting under Flapdaddy's authority may use winner's name, picture/portrait likeness and/or voice, for advertising and promotional purposes without further consideration or notice. By submitting text, files, images, photos, video, sounds, musical works, works of authorship, or any other materials (collectively, "Content"), Contestants grant Flapdaddy and its affiliates and agents permission to use the Content in whole or in part for any purpose and in any media whatsoever, without further compensation to entrants. Selected Content may be posted on Flapdaddy's or its agent's promotional website(s) during the Contest Period, if deemed appropriate by Flapdaddy and in Flapdaddy's sole discretion. Flapdaddy is not liable for any printing or production errors associated with the contest. BY ACCEPTING THE PRIZE, THE WINNER AGREES THAT FLAPDADDY, ITS PARENTS, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF FLAPDADDY'S OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, DISTRIBUTORS, AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER FOR ANY LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS CONTEST OR PARTICIPATION IN ANY CONTEST OR PRIZE RELATED ACTIVITY. The Contest shall be construed only according to U.S. law. Contestants agree the Contest is governed by Texas law and is subject to all federal, state and local laws. Void where prohibited by law. Any other attempted form of entry other than as specified herein is prohibited; no automatic, programmed, robotic or similar means of entry are permitted. Your submission of an entry, constitutes your consent to participate in this Contest, your authorization to Flapdaddy to communicate with you by email and by telephone to obtain and deliver your name, address, phone number and other information to Flapdaddy's affiliates for the purpose of administering this Contest. 6.  Miscellaneous: In the event of a dispute, entries made by Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Flapdaddy with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. If for any reason the Contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Flapdaddy that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Flapdaddy reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. Flapdaddy assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Contestants agree that in the event of a dispute, Flapdaddy's decisions are final. Flapdaddy is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Flapdaddy on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Contest. Sponsors are not responsible for late, lost, illegible, incomplete, stolen, or misdirected entries. CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, FLAPDADDY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. CONTEST MAY BE DISCONTINUED IF THRE IS EVIDENCE OF HACKING OR OTHER TYPES OF SECURITY BREACHES.
